Theme
Central theme: Energy Law & Climate Justice
The 3rd Justice Hidayatullah International Moot Court Competition, 2026 centers on a dispute between the Centre for Clean Energy and Mitigation of Effects of Climate Change (CCE&MCC), an NGO led by clean-energy advocate Sesha Ramaswami, and various authorities of the Union of Bharnesia (UOB), including the Department of Energy, Central Electricity Regulatory Commission, Prakrith Nadu Electricity Board, and the Department of Non-Conventional Energy. The case arises from the unequal treatment of small-scale biomass power producers in Prakrith Nadu, where thousands of farmers have adopted 10 kWh nano-biomass gasification units supported by the NGO. Despite contributing to renewable energy generation, these producers receive significantly lower subsidies than solar and wind units and are barred from trading carbon credits unless their installed capacity exceeds 100 kWh. Combined with delayed subsidies and restrictive power-purchase policies, these measures have hindered the economic viability of clean biomass energy. After repeated representations failed, the NGO filed writ petitions before the Supreme Court of Bharnesia seeking a fair and non-arbitrary renewable-energy subsidy regime, parity in treatment with other clean-energy sectors, and the quashing of circulars restricting carbon-credit transfer rights. The dispute thus raises complex issues of clean-energy policy, equality before law, administrative arbitrariness, and the constitutional obligations of the State in promoting sustainable development.
